Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") are a legal agreement between you and vmello media LLC, an Indiana limited liability company doing business as "HueU" (publicly styled "Hue U") ("Hue U," "we," "our," or "us"), governing your use of the Hue U website at hueu.ai(the "Service").

By creating an account, checking the "I agree" box during signup, or otherwise accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. How the Service Works

Hue U transforms your photos into coloring book pages using AI. You can color pages digitally within the app and order professionally printed coloring books delivered to your door. The Service uses a credit system — you purchase credits, then spend them to generate coloring pages.

3. Account Registration

To use the Service, you must create an account using Google Sign-In, Apple Sign-In, email/password, or magic link. You are responsible for maintaining the security of your account and for all activity under it. You must be at least 13 years old to use the Service.

You agree to provide accurate information and to notify us promptly if you believe your account has been compromised.

4. Credits and Payments

  • Credits are purchased via Stripe.
  • Credits are non-transferable and tied to your account.
  • Credit prices are displayed at time of purchase and may change. Previously purchased credits are not affected by price changes.
  • Each image generation consumes one credit. Credits are deducted when processing begins, regardless of whether you are satisfied with the result.
  • All prices are in US dollars unless otherwise stated.

5. Printed Books and Orders

  • Printed books are produced and shipped by our fulfillment partner, Lulu.
  • Shipping costs and estimated delivery times are displayed before you confirm your order.
  • Prices for printing and shipping are shown at checkout and may vary based on book specifications and shipping destination.
  • Once an order is submitted to production, it cannot be canceled.
  • Delivery times are estimates and may vary due to carrier or fulfillment delays beyond our control.

6. Refund Policy

Credits

All credit purchases are final and non-refundable. Credits have no cash value and cannot be exchanged or transferred.

Blocked or Flagged Uploads

Generations that are refused by our content filters for violating these Terms (see Acceptable Use) are non-refundable, and the credit used will not be returned. We do not store images that are flagged as inappropriate. Repeated attempts to upload prohibited content may result in your account being flagged, suspended, or terminated.

Printed Books

If your printed book arrives damaged or with a printing defect, contact us within 14 days of delivery with photos of the issue. We will arrange a replacement or refund at our discretion. We cannot offer refunds for dissatisfaction with AI coloring page quality, as you preview all pages before ordering.

7. Your Content

  • You retain ownership of the photos you upload and the coloring pages you create.
  • By uploading photos, you grant us a limited, non-exclusive license to process them through our AI pipeline, store them, and include them in your printed books — solely to provide the Service to you.
  • You represent that you own or have the necessary rights to all photos you upload. Do not upload photos that infringe on the rights of others.
  • We do not claim ownership of your content. We and our third-party providers may use data to improve our respective services.
  • You own the coloring pages you generate from your photos. You may use them for personal and household purposes, including the printed books you order. Commercial redistribution at scale requires our written permission (see Acceptable Use).

8. Acceptable Use

You agree not to:

  • Upload content that is illegal, harmful, obscene, or violates the rights of others
  • Use the Service to generate content depicting minors in harmful or inappropriate situations
  • Attempt to reverse-engineer, decompile, or extract the source code of the Service
  • Use automated tools, bots, or scripts to scrape, bulk-access, or overload the Service
  • Circumvent rate limits, access controls, or other security measures
  • Resell or commercially redistribute generated content at scale without our written permission
  • Impersonate another person or misrepresent your affiliation

We reserve the right to suspend or terminate accounts that violate these Terms, with or without notice. Uploads refused by our content filters are non-refundable (see Refund Policy).

9. AI-Generated Content

Coloring pages are generated by artificial intelligence. Results may vary in quality depending on input photo characteristics. We do not guarantee that every photo will produce a satisfactory coloring page. You can preview all results before spending additional money on a printed book.

10. Service Availability

We strive to keep the Service available and reliable, but we do not guarantee uninterrupted or error-free access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any loss or inconvenience resulting from Service unavailability.

11. Warranty Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HUE U SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR BUSINESS INTERRUPTION.

OUR TOTAL AGGREGATE LIABILITY FOR ANY AND ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR FIFTY DOLLARS ($50), WHICHEVER IS GREATER.

13. Indemnification

You agree to indemnify, defend, and hold harmless Hue U and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your content, or your violation of these Terms.

14. Termination

You may delete your account at any time by contacting support@mail.hueu.ai. We may suspend or terminate your account if you violate these Terms or for any other reason with reasonable notice, except where immediate termination is necessary to protect the Service or other users.

Upon termination, your right to use the Service ceases immediately. Your data will be handled as described in our Privacy Policy. Credits are not refundable upon termination.

15. Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Indiana, United States, without regard to conflict of law principles.

Before filing a formal dispute, you agree to contact us at support@mail.hueu.ai and attempt to resolve the matter informally for at least 30 days. If we cannot resolve the dispute informally, any legal action shall be brought in a state or federal court of competent jurisdiction located in the State of Indiana, and you consent to the jurisdiction of those courts.

16. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date at the top of this page and, where appropriate, notify you via email or an in-app notice. Your continued use of the Service after the effective date of revised Terms constitutes your acceptance of the changes.

We respect intellectual property rights and expect our users to do the same. If you believe content on the Service infringes a copyright you own, email us at support@mail.hueu.ai with the subject line "Copyright Complaint" and include: (1) a description of the copyrighted work; (2) the specific content you believe is infringing and where it appears; (3) your contact information; (4) a statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law; and (5) a statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf. We will remove infringing content and may terminate the accounts of repeat infringers.

18. General

  • Entire agreement — these Terms and our Privacy Policy are the entire agreement between you and us regarding the Service and supersede any prior agreements on the subject.
  • Severability — if any provision of these Terms is held unenforceable, the remaining provisions stay in full effect.
  • No waiver — our failure to enforce any provision is not a waiver of our right to enforce it later.
  • Assignment — you may not assign or transfer these Terms without our consent. We may assign them in connection with a merger, acquisition, or sale of assets.
  • Force majeure — we are not liable for delays or failures caused by events beyond our reasonable control, such as outages of third-party providers, natural disasters, or carrier disruptions.
